CONDITIONS OF PARTICIPATION DEUTER ANNIVERSARALLY
Conditions of Participation
Participation in the deuter Anniversarally as well as in the associated competition of Deuter Sport GmbH, Daimlerstraße 23, 86368 Gersthofen, hereinafter referred to as the "organizer," is free of charge and is exclusively subject to these conditions of participation.
Eligible participants
Eligible participants are natural persons who reside in Germany, Austria, and Switzerland and have reached the age of 18, hereinafter referred to as "participants". Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.
Employees of the organizer and partner companies who provide individual prizes as well as their family members are not eligible to participate in the competition. The organizer also reserves the right to exclude persons from participation at its own discretion if there are legitimate reasons, such as
a) in the event of manipulations in connection with the execution of the competition,
b) in the event of violations of these participation conditions,
c) in the event of false or misleading information in connection with participation in the competition.
For the prizes (1x Garmin fenix® 7, 1x LOWA RENEGADE GTX Mid, 1x LEKI MAKALU LITE or CRESSIDA, 1x CEP functional socks, 1x deuter package worth 250 €, 1x a backpack model of choice from the 125 anniversary edition, 1x a deuter goodie bag for each prize category), participants are expected and required to have good physical condition, appropriate knowledge, and safe performance in their respective disciplines. The participants confirm that they are fit to travel under these conditions and that they are not aware of any health restrictions that would prevent them from participating in the activity/travel.
Participation
Participation in the competition is via the deuter website and the partner sites of selected deuter retailers in Germany, Austria, and Switzerland. Participating retailers will refer to the individual web pages created specifically for this competition via their social media channels. Participation involves registering by end consumers and receiving confirmation from deuter regarding their chosen activity, as well as submitting a completed entry form on the individual web pages.
In addition, participants agree that their tour will be recorded via a GPS tracker for the purpose of coordination, tracking of backpack whereabouts and illustration of the tour on the website.
Only fully completed registration forms with answered questions will be eligible for the competition. By submitting the entry form, participants accept these terms and conditions. Participation is only possible up until the entry deadline. Entries received after the deadline will not be considered.
The entry period for the competition begins at 12:01 AM (Berlin) on May 9th, 2023 and ends at 11:59 PM (Berlin) on August 13th, 2023.
Only one entry per participant is allowed.
Prize, Notification, and Prize Delivery
The following prizes will be awarded:
Among the participants of all deuter retailers in Germany, Austria, and Switzerland, the prize will be 1x Garmin fenix® 7, 1x LOWA RENEGADE GTX Mid, 1x LEKI MAKALU LITE or CRESSIDA, 1x CEP functional socks, 1x deuter package worth 250 €, 1x backpack model of choice from the 125th Anniversary Edition, and 1x deuter goodie bag per competition category. Participation is at the participant's own risk. Depending on conditions and weather, the tour destination may also vary.
The winners will be determined at the end of the entry period by random selection from all participants. The jury will consist of representatives of the organizer.
The winner(s) will be notified by email within two weeks of the end of the entry period by the organizer. If the notification is undeliverable, the organizer is not obligated to conduct further inquiries and may choose a new winner. If the winner does not respond within one week of the prize notification, the organizer is also entitled to choose a new winner.
The prize will be awarded exclusively to the winner. Transfer, exchange, self-collection, and cash payout of the prize are not possible. The winner is responsible for any tax implications of the prize.
The organizer reserves the right to award a substitute prize of reasonable value at their own discretion if a prize described in these official rules is not available or cannot be fully awarded for any reason. If the actual value of the prize is below any suggested retail price, the difference will not be paid in cash. The organizer makes no representations or warranties regarding the appearance, safety, or quality of the prizes. There may be restrictions, conditions, and limitations that apply. The organizer does not replace lost or stolen prizes.
If, due to dynamic developments in the COVID-19 pandemic, such as an increasing number of infections and new corona measures, the organization or participation in the deuter Anniversary Rally is not possible, the right to the prize may be forfeited. The organizer will require compliance with the health regulations in place at the event location for participation in the event and reserves the right to implement stricter rules to protect the health of all participants. In such cases, there is no entitlement to substitute prizes, payout of the value of the prize, replacement dates, and/or reimbursement of any travel costs incurred.
Termination of the competition
The Promoter expressly reserves the right to suspend or terminate the Competition or amend these Terms and Conditions at any time without prior notice and without giving any reason.
Data protection
Personal data must be provided in order to participate in the competition. The participant assures that the personal data provided by him/her, in particular first name, surname and e-mail address, are true and correct. In the case of non-cash prizes, further personal data, such as the address, will be requested from the winners after the end of the competition as part of the notification of the prize. The collection and processing of personal data is solely for the purpose of conducting the competition and, if applicable, sending the prizes. All data will only be stored for the purpose and for the duration of the competition and will be deleted at the end of the campaign, unless there is a legal obligation to retain the data. Data will only be passed on by the organiser to Social Pals GmbH and the parties involved in the implementation of the winning trip, insofar as this is absolutely necessary for the implementation.
In the event of a win, the winning person agrees to the publication of his/her name and place of residence in the advertising media used by the organiser. This includes the announcement of the winning person on the website of the organiser and its social media platforms as well as reporting during and after the event (three-day tour) via the social media platforms and print products of the organiser.
Participants can obtain information about their data stored by the organiser at any time, object to the use of their data and request its deletion. A simple letter to Deuter Sport GmbH, Daimlerstraße 23, 86368 Gersthofen is sufficient for this purpose.

Granting of rights by the winners
By participating in the competition, the participants undertake to grant the organiser the right, free of charge, to use photographs, pictures, videos or sound recordings of the winners taken at the deuter Anniversarally for publication and communication purposes in relation to the competition. The right of use is granted for an unlimited period of time.
Facebook Disclaimer
The competition is not connected to Facebook/Instagram and is in no way sponsored, supported or organised by Facebook/Instagram. The contact person and person responsible is solely the organiser.
Liability
The Promoter shall not be liable for any loss or damage caused by errors, delays or interruptions in transmission, faults in technical equipment and services, inaccurate content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such loss or damage was caused intentionally or by gross negligence on the part of the Promoter (its bodies, employees or vicarious agents). The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.
Applicable law
The competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
Severability clause
Should any provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. The invalid provision shall be replaced by a legally permissible provision that most closely approximates the economic intent and purpose of the invalid provision. The same shall apply in the event of a loophole in these Conditions of Participation.
