GENERAL TERMS AND CONDITIONS

1. SCOPE 

For all deliveries from the DEUTER online store to customers (hereinafter "Customer"), these General Terms and Conditions apply exclusively in the version valid at the time of the order.

The customer is a consumer if he is a natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor his independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or independent professional activity.

Deliveries from the deuter online store are made within Austria.

2. CONTRACTUAL PARTNERS, CUSTOMER SERVICE

The purchase contract is concluded with Redler Sports GmbH, Wolfurterstrasse 4, 6923 Lauterach / Bregenz (hereinafter "DEUTER AT"). Redler Sports GmbH represents the DEUTER brand in Austria.

3. DEVIATING CONDITIONS

Any terms and conditions of the customer that deviate from these General Terms and Conditions shall not be recognized unless DEUTER AT expressly agrees to their validity in writing.

4. OFFER AND CONCLUSION OF CONTRACT, ORDERING PROCESS

The customer can choose backpacks, bags, sleeping bags and other products from the DEUTER range.

Using the "Add to shopping cart" button, the customer collects the products they wish to order in a so-called shopping cart. The products can be removed from the shopping cart at any time by clicking on the "Remove product" button. The selected products can be purchased by clicking on the "Proceed to checkout" button. By clicking on the "Buy now" button, the customer places a binding order for the goods in the shopping cart.

The customer can view and change their entries at any time before placing a binding order. In addition, all entries are displayed again in a confirmation window before the binding submission of the order and can also be corrected there using the usual keyboard and mouse functions.

The order can only be placed and transmitted if the customer has accepted the General Terms and Conditions by ticking the appropriate box and thereby accepted them in his application. Before placing the order, the customer is informed about the right of withdrawal, availability of the goods, delivery times and accepted means of payment.

The data protection provisions of DEUTER AT apply to orders in the DEUTER online store.

Confirmation of receipt of the order will be sent immediately after sending by an automated
e-mail (confirmation of receipt). The confirmation of receipt also contains the submission of a declaration of acceptance by DEUTER AT (order confirmation).

The purchase contract is concluded when DEUTER AT issues a declaration of acceptance. The customer's order is listed again in the order confirmation.

DEUTER AT reserves the right to withdraw from the purchase contract in the event that a consumer has actually acted in the exercise of a commercial or independent professional activity. To this end, DEUTER reserves the right to check customer details if the scope of the order does not correspond to normal household quantities.

  

The order confirmation contains these General Terms and Conditions and the data protection provisions as an attachment. The order confirmation is saved by DEUTER AT. The order confirmation and the General Terms and Conditions can be printed out by the customer at any time using the "Print" function.

The order confirmation is decisive for the content and scope of the contract. Subsidiary agreements, amendments, supplements, etc. require a separate confirmation, which will be sent by separate e-mail.

5. PRICES AND TERMS OF PAYMENT

All prices quoted include the applicable statutory value added tax.

Shipping Austria: Shipping costs 8,50 €, free shipping from an order value of 75 €.

The purchase price and shipping costs are clearly communicated to the customer on the order page, in the order confirmation and on the invoice.

The customer can choose between the payment methods offered during the ordering process: payment by credit card (VISA & Master Card are accepted) and PayPal.

For the following payment methods: credit card and PayPal, payment of the purchase price, including shipping costs, is due upon conclusion of the contract.

Offsetting by the customer is only permitted if his claim is undisputed or has been legally established.

Invoices are issued exclusively electronically with the shipping confirmation. The invoice can be printed out by the customer at any time using the "Print" function.

6. DELIVERIES, HANDOVER OF THE GOODS

Delivery is only possible within Austria. The goods are shipped with DPD. A pick-up option at DEUTER AT is not offered.

DEUTER AT shall bear the shipping risk for ordered goods if the customer is a consumer. If the customer is an entrepreneur, shipment shall be at the customer's risk.

Items are usually dispatched within one to three working days (i.e. Monday to Friday, excluding public holidays) after the order confirmation has been sent. Information on delivery times does not constitute binding or guaranteed shipping or delivery dates. The goods are handed over by delivery to the delivery address specified by the customer.

If no copies of the product are available at the time of the order, DEUTER AT shall inform the customer of this before the order is placed. The customer has the option of being informed about the availability of the goods by e-mail.

In the event of a delay in delivery of more than two weeks, the customer has the right to withdraw from the contract. In this case, DEUTER is also entitled to withdraw from the contract. Any payments already made by the customer shall be reimbursed by DEUTER without delay.

7. RESERVATION OF TITLE

The delivered goods remain the property of DEUTER AT until full payment has been received.

8. STATUTORY LIABILITY FOR DEFECTS

The statutory liability for defects applies to contracts with consumers.

DEUTER AT accepts no responsibility for the options selected by the user, such as the choice of order quantity or product type.

Deviations of the ordered or delivered goods from the order, in particular with regard to material and color, are reserved for technical reasons.

An additional guarantee only exists if this was expressly stated in the order confirmation for the respective product.

Claims of the customer for damages are excluded. Excluded from this are claims for damages by the customer arising from injury to life, limb, health or the breach of essential contractual obligations as well as liability for other damages based on an intentional or grossly negligent breach of duty by DEUTER AT its legal representatives or vicarious agents. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

In the event of a breach of material contractual obligations, DEUTER AT shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer's claims for damages are based on injury to life, limb or health.

The restrictions also apply in favor of the legal representatives and vicarious agents of the provider if claims are asserted directly against them.

For contracts with consumers, the warranty period is two (2) years from receipt of the goods.

The provisions of the Product Liability Act remain unaffected.

9. RIGHT OF WITHDRAWAL FOR CONSUMERS

The consumer may withdraw from the contract within thirty days without giving any reason. The withdrawal period is thirty days from the day on which the consumer or a third party named by the consumer, who is not the carrier, has taken possession of the goods.

In order to exercise the right of withdrawal, the consumer must inform DEUTER AT by means of a clear statement (e.g. letter, online form or e-mail) of the decision to withdraw from the contract.

The consumer may use the attached model withdrawal form for withdrawal, but this is not mandatory. The attached sample withdrawal form or another clear declaration can also be filled out and sent electronically on the DEUTER AT website.

The consumer must return or hand over the goods to DEUTER AT immediately and in any case no later than thirty days from the day on which he informed DEUTER AT of the revocation of this contract. The deadline is deemed to have been met if the consumer sends the goods before the period of fourteen days has expired.

The goods are to be returned at DEUTER AT's risk. DEUTER AT shall bear the costs of the return shipment.

In order to comply with the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.
If the contract is revoked, DEUTER AT shall reimburse the consumer for all payments received by DEUTER AT from the consumer, including delivery costs, without delay and at the latest within thirty days from the day on which DEUTER AT receives notification of the revocation of this contract. The same means of payment used by the consumer in the original transaction will be used for this repayment, unless expressly agreed otherwise with the consumer; in no case will the consumer be charged any fees for this repayment. DEUTER AT may refuse repayment until DEUTER AT has received the goods back or until the consumer has provided proof that he has returned the goods, whichever is the earlier.

The consumer only has to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functionality.

10.   Assignment

Claims against DEUTER AT to which the Customer may be entitled arising from the business relationship may not be assigned to third parties.

11.    NOTE ON DATA PROCESSING

DEUTER AT collects customer data as part of the processing of contracts. DEUTER AT undertakes to treat the personal data of customers confidentially in accordance with data protection regulations (in particular the GDPR, the Federal Data Protection Act and the Telemedia Act).

12.    FINAL PROVISIONS

All legal relationships between DEUTER AT and the customer are subject to Austrian substantive law. The Vienna Sales Convention is not applicable. The exclusive place of jurisdiction is Vienna.

The European Commission provides a platform for online dispute resolution, which you can find at https://ec.europa.eu/consumers/odr/. DEUTER AT prefers to clarify customer concerns in direct exchange and therefore does not participate in consumer arbitration proceedings. Please contact DEUTER AT directly if you have any questions or problems.

Should any of the above provisions be invalid in whole or in part, this shall not affect the validity of the remaining provision(s) or the contract.
